What is personal information?

What personal information do we collect?
Personal information may be collected in a number of ways when you visit our Site or use the RivePoint Service. We may collect certain information you voluntarily provide to us which may contain personal information. For example, we may collect personal information, such as but not limited to your mobile number and other information when you register and set up an account, send us a text message or contact us by e-mail or other means for any reason. In addition, from time to time we may collect demographic, contact or other personal information you provide in connection with your participation in surveys, sweepstakes, contests, games, promotional offers, and other activities on the Site or through the RivePoint Service.
When you use the RivePoint Service, whether via our web site or your mobile device, some information is also automatically collected, such as your Internet Protocol (IP) address, your operating system, the browser type, the address of a referring web site, and your activity on the Site. We treat this information as personal information if we combine it with or link it to any identifying information. Otherwise, it is used in the aggregate only. We may also automatically collect certain information through the use of "cookies." In addition, you understand that use of the RivePoint Service includes the disclosure and display of your Location Data to RivePoint, your wireless carrier, and third-party partners. Please be aware, however, that although we endeavor to use commercially reasonable efforts to implement these restrictions (the restriction of user access to certain information such as your location data) and honor these designations, no system or security measure is perfect or impenetrable, and therefore, we cannot guarantee that this information will not be available to others. In addition, you should be aware that information and Location Data may still be shared with carriers, Service Providers and other third parties in accordance with the provisions of this Policy. Your use of the RivePoint Service constitutes your consent to share this information in such manner and all such sharing of information is done at your own risk.
In addition, we may disclose personal information in the good faith belief that we are lawfully authorized or required to do so, or that doing so is reasonably necessary or appropriate to comply with the law or with legal process or authorities, respond to any claims, or to protect the rights, property or safety of RivePoint, our users, our employees or the public, including without limitation to protect RivePoint or our users from fraudulent, abusive, inappropriate or unlawful use of our Site or the RivePoint Service. Information about our users, including personal information, may also be disclosed or transferred as part of, or during negotiations of, any merger, sale of company assets, financing or acquisition or in any other situation where personal information may be transferred as one of the business assets of RivePoint.
What steps do we take to protect personal information online?
We have endeavored to put into place reasonable security measures in an effort to protect personal information while it is under our control. Your account information is accessible only through the use of a password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of our website and/or Service by any person using your password. Please advise us immediately if you believe your password has been misused.
What choices do you have regarding the use of your personal information?
If you do not wish to receive further communications from us to your mobile device, then you may opt out of receiving any SMS text messages by RivePoint by sending the text STOP to the RivePoint service from the mobile device. You may at any time withdraw your consent to the use and disclosure of your location data. However, such withdrawal will prevent you from using certain features of the RivePoint Service such as locating vendors within your proximity via your GPS-enabled device.
Collection of information from children under 13
The RivePoint Service is not intended for use by children under 13, and you must be 13 or older to create an account. By registering for the RivePoint Service or using the Site, users represent to us that they are 13 or over, and we do not knowingly collect any information from anyone we actually know is under 13 years of age. If you are under 13, do not attempt to create an account and do not provide any personal information on our Site or through our RivePoint Service.
